Terms of use

Thank you for using Howe. These Terms of use (the "Terms") govern your access to and use of howe.com.ar, the application (app.howe.com.ar) and Howe's services (together, the "Services"). By creating an account or using the Services you accept these Terms and our Privacy policy. If you use them on behalf of a company, you state that you have the authority to bind it, and "you" includes that company.

If you don't agree with these Terms, don't use the Services.

1. Your account

  • You must be at least 18 years old and able to enter into an agreement in your own name or on behalf of your company.
  • You must give us true information and keep it up to date. Take care of your credentials: you are responsible for what is done with your account, for the people on your team you give access to and for the roles you assign them. If you suspect unauthorized use, tell us right away at hola@howe.com.ar.
  • We may offer access by invitation or in stages while we expand the Services.

2. The Services

Howe is a store CRM with AI agents and an online store builder. It helps you manage the catalog, orders, prices and margins, suppliers and competition of your channels (such as Mercado Libre and Tiendanube) and of your Howe store, build documents with your business's data, and create, edit and publish your own store hosted on Howe. Some features, such as the agent, competition analysis and the AI code editor, come only with certain plans.

We improve the Services all the time: we may add, change or stop offering features. If a change significantly affects what you signed up for, we'll let you know in advance. Features we label as trial versions may change or fail more often.

3. Plans, prices and payments

  • The plans (Free, Pro and Ultra), what each one includes, their prices and the commission per sale are on the pricing page. Prices are set in US dollars and shown in Argentine pesos as a reference, at the exchange rate that page states.
  • Sales from your Howe store pay a commission according to your plan at the time of the sale, and the rate stays fixed on the order.
  • How and when you pay, and any applicable taxes, are communicated when you sign up for a plan.
  • You can change plans. If you move down a plan, your published store stays published and you don't lose products, photos or orders: what the new plan doesn't cover, like the agent or the code editor, is locked but not deleted.
  • Each plan's AI usage has limits, which renew every month. We may change prices and limits by letting you know beforehand, and the change applies to the following period.

4. Your content

Your content is your business's data and files, your requests to the agent and everything you load or publish with Howe, for example the texts and images of your store. You remain the owner of your content.

You grant us a limited, non-exclusive, worldwide license to host, process, display and transmit your content only to provide you with the Services: for example, sending it to an AI provider to answer your request or showing it in your published store. The license ends when your content is deleted, except for backups, for the time explained in the Privacy policy.

You state that you have the rights to load and use your content and that it doesn't infringe third-party rights or the law. We don't use your content to train models.

5. The AI agent and its results

Howe's agent uses artificial intelligence models to read your lists, calculate, propose changes and build documents. The answers and proposals it generates (the "Results") may contain errors or be incomplete, so review them before using them.

The agent proposes and you decide: no change reaches your channels without your approval or without an autonomy policy you chose, and a price that loses you money is never applied automatically in any mode. Every change shows the before and the after and can be undone. You are responsible for what you approve and for the autonomy you choose to give it.

Calculations, such as the real margin, depend on the data and commissions you load or that your channels provide. The Results are not accounting, tax or legal advice.

You may use the Results in your business. Because other people may receive similar results, we don't guarantee they are unique.

6. Third-party platforms

Howe connects with third-party platforms, such as Mercado Libre, Tiendanube and WhatsApp (Meta). To use them you need your own account and must comply with their terms. By connecting them, you authorize us to act on your behalf within the permissions you grant, through their official APIs and never with your password. You can disconnect them whenever you want.

Those platforms are not part of Howe: we don't control their services, their terms or their changes, and we aren't responsible for them. If a platform changes its rules or limits access, we may suspend or modify the integration.

7. Your store on Howe

If you create a store with Howe, you are the seller. Howe provides the technological infrastructure to build, host and publish it, and the business is yours: you are responsible for the products, prices, customer service, shipping, invoicing, taxes and policies of your store, and for complying with the laws that apply to you, including consumer protection and e-commerce laws.

You are responsible for your store's content. You may not sell products or services the law prohibits or use the store to deceive your buyers. For your buyers' data, see section 4 of the Privacy policy: you are the controller and Howe is the processor.

8. Acceptable use

You agree not to use the Services to:

  • do anything illegal or violate other people's rights;
  • try to access accounts, organizations or data that aren't yours, or test or bypass security measures;
  • upload viruses or other harmful code, or use bots, scraping or automation on Howe without our permission;
  • overload the Services, resell them or give third parties access outside your organization's roles;
  • copy, decompile or reverse engineer the software, except as the law allows;
  • ask the agent to generate illegal or deceptive content, or try to make it ignore its rules.

If you find a security flaw, write to us at hola@howe.com.ar: test only with your own account and without accessing other people's data.

9. Our intellectual property

Howe, its software, its brand, its design and everything that isn't your content belong to us or our licensors and are protected by law. We give you a limited, personal, non-exclusive, revocable and non-transferable license to use the Services under these Terms. If you send us feedback or ideas, we may use them to improve the Services without paying you or giving you credit.

10. Availability and support

We do our best for the Services to be available and work well, but they may have interruptions due to maintenance or to failures of ours or of third parties. Unless we agree otherwise in writing, we offer them without an availability commitment. We recommend keeping a copy of whatever is important for your business.

11. Suspension and termination

You may stop using the Services whenever you want and ask to close your organization by writing to hola@howe.com.ar: its data is deleted as the Privacy policy explains. We may suspend or close your account if you breach these Terms, if there is a security or legal risk, if a plan isn't paid or if the law requires it. When possible, we'll let you know beforehand and give you the chance to fix it.

When it ends you lose access, so download what you need beforehand. The sections that by their nature must remain in force, such as intellectual property, the limitation of liability and the governing law, remain in force.

12. No warranties

To the extent the law allows, the Services are offered "as is" and "as available", without warranties of any kind, express or implied, including those of merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that the Results are accurate or that the Services are free of errors or interruptions.

13. Limitation of liability

To the extent the law allows, Howe is not liable for indirect damages, lost profits or loss of sales, opportunities or data, or for the consequences of the prices, changes or listings you approved, or for failures of third-party platforms. And our total liability to you for any claim is limited to what you paid us for the Services in the 12 months before the event. None of this excludes liability that the law doesn't allow to be excluded.

14. Indemnity

You agree to hold Howe harmless against third-party claims arising from your content, from what you sell with your store or from your use of the Services in breach of these Terms or the law.

15. Changes to these Terms

We may update these Terms. If the change is important, we'll let you know in advance by email or in the application, and the date above shows the last update. If you keep using the Services after the change, you accept the new Terms; if you don't agree, you can close your account.

16. Governing law and jurisdiction

These Terms are governed by the laws of the Argentine Republic. For any dispute, the parties submit to the ordinary courts of the Autonomous City of Buenos Aires, without prejudice to mandatory rules that give you the right to go to another jurisdiction.

17. General provisions

These Terms and the Privacy policy are the entire agreement between you and Howe about the Services. If a part is found invalid, the rest remains in force. Our not exercising a right doesn't mean we waive it. You may not assign these Terms without our permission; we may assign them in a reorganization. Notices are given by email or in the application. If there is a translation, the Spanish version prevails.

18. Contact

If you have questions about these Terms, write to us at hola@howe.com.ar.
